This page describes the terms and conditions for goods and services (Agreement) provided by Repairs a unit of Hearing Square owned and operated by Ausy Resolutions.

1. Consultation Fees

a) It’s Free for Ausy and Hearing Square Subscribed Members.

b) For others, first consultation is Free Subsequent consultations will be charged at Rs.300 and accordingly AUSY reserves the right to waive or charge.

2. Payment of Hearing Aid Repairs

a) Once the estimation is given and have approved full payment should be transferred to our account after this the service process will be carried out.

b) Incase if you disapprove our estimation only the courier and handling charges Rs.300 to be transferred to our account.

c) Service Charges estimation to be approved within 7 days from the time of intimation and if the payment not made within 15 days company will not hold responsible for your device and it cannot be claimed after two months.

3. Payment of New and Exchange Hearing Aids

a) After the discount / Exchange rates the balance Full payment should be made in advance to our account.

5. Postage of Hearing Aids and devices

a) If hearing aids are bought from Ausy Free postal up to warrantee period anywhere in India.

b) For others Rs.300 minimum charges and this may vary depending on the size of the parcel will be intimated.

c) To the extent permitted by law Ausy cannot be held accountable for delays in courier and shipping or loss and damage while the hearing aid or device in transit.

d) All parcels will be sent through either Blue Dart/Professional/DTDC/SpeedPost

6. Refunds and Returns

Service Hearing Aid

a) No Refunds

b) Since we are handling old hearing aids when we open the hearing aid there is a possibility due to moisture and wear and tear we cannot guarantee to return in the same condition in case the estimation is not approved.

New Hearing Aid  / Exchange New Hearing Aid

a) In case you are not happy with the product quality you may upgrade it to the next higher level within 15 days’ time.

b) Any Fitting issues will be sorted out with online assistance free of cost.

c) No Refunds

7. Warranty

Service Hearing Aid

a) No warranty for general service and cleaning

b) If Receiver or Mic changed 6 months company warranty

c) If motherboard changed 12 months company warranty

d) Domes, wax guards, battery door, body case, Mould no warranty

New Hearing Aid

a) All devices have manufacturer’s warranties it varies from 3 months to 4 years depending on the product

b) Warranty covers only the manufacturing defects

c) Any physical damage due to water – heat – mishandling to the body case, battery door, domes, ear moulds, or receiver will not be covered by warranty

8. Maintenance of New and Serviced Hearing Aid

a) Every day clean the hearing aid with the brush and cloth as explained in the manual

b) Change the wax guard every 3 months periodically

c) Keep the Hearing Aid in the Dry Box without battery in the night.

d) Dispose of the old batteries and change new batteries when low battery indication bell rings.

e) Zinc Air batteries are used in the hearing aid so when it’s required peal of the sticker from the battery and insert it in the hearing aid . Pealing of the sticker early will dry the battery and it may go dead before the usage.

f) Periodical fine tuning of the hearing aid is necessary at least once in two years.

9. Medical Service Provider

a) The client acknowledges that none of the services provided to the client are medical services and that Ausy and its personnel are technicians and audiologist and are not registered medical practitioners. If any medical advice is necessary Ausy recommends the client seek the services of their GP, Otolaryngologist or ENT.The client indemnifies Ausy for any claim by any person alleging in whole or in part that Ausy provide medical services in relation to the client.

10. Subcontracting

a) Ausy may engage a subcontractor to perform some or all of the services in relation to the client’s devices.The engagement of the subcontractor does not relive Ausy of its obligations.

11. Liability and Indemnity

a) Ausy relies on the client to use the Device for their intended use and in the manner prescribed by the manufacturer.  Failure to follow instructions by the client, the client agrees to indemnify Ausy for those losses, damages, and costs including those relating to any personal injury.

b) To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities, and other terms implied or conferred by statute, custom, or the general law that impose any liability or obligation on Ausy are excluded under this Agreement.  If a supply under this Agreement is a supply of goods or services to a consumer within the meaning of the Indian Consumer Law, nothing contained in this agreement excludes, restricts, or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Indian Consumer Law, provided that, to the extent that the Indian Consumer Law permits Ausy to limit its liability, then Ausy liability shall be limited to supplying the goods and services again or payment of the cost of having the services supplied again.

c)  Under no circumstance will Ausy be liable to the client for any:

i) loss or liability to the extent caused or contributed by the client

ii) consequential, incidental, or special loss or damages including loss of profits, loss of revenue, or loss of opportunity, however, it arises; or

iii) punitive or exemplary damages.

12. Privacy

a) Ausy collects personal information from clients in order to provide its products and services.  Ausy handles personal information in accordance with its Privacy Policy, which forms part of these terms.

b) The Privacy Policy outlines the types of personal information Ausy collects, the purposes for which it is collected, to whom it is disclosed, how it is held and kept secure and clients’ rights in relation to their personal information, including how to access your personal information.

13. General

a) This Agreement may be executed in any number of counterparts. All executed counterparts taken together constitute one agreement.

b) This Agreement may only be amended by the Ausy.

c) Any waiver of any provision or condition of this Agreement permitted only to Ausy

d) art or all of a provision of this Agreement that is unenforceable may be severed from this Agreement and the remainder of this Agreement will continue in force.

e) This Agreement is governed by the law of India and the applicable laws of the Indian consumer act.  The client irrevocably and unconditionally submits to the jurisdiction of the Courts of Chennai India.

14. System requirements for Online Video Consultation

a) You need to have an internet connection

b) You can use a laptop/desktop / mobile (android/iOS) to attend your online video consultation.

c) Use a headphone to communicate with our expert

d) A silent environment is preferred

15. Online Video Consultation Terms and Conditions of Use

a) These Terms and Conditions (Terms) apply to your use of Connect Hearing’s Online Chat service (Online Chat). If you are under 18 years of age, you should obtain the consent of a parent or legal guardian prior to using Online Chat. Your use of Online Chat constitutes acceptance of these Terms.

b) Ausy Hearing will retain written records of Online Chat sessions.

c) Ausy Hearing does not agree to you keeping or disclosing a written record of the Online Chat session without Connect Hearing’s prior written consent.

d) Online Chat is available from 10.30 AM-6 PM Mon-Sat with such hours subject to change at Ausy Hearing’s discretion.

e) Ausy Hearing’s Online Chat team members use reasonable care and skill to deliver complete, accurate, and current information. If the team member cannot answer your question, the team member will use their best endeavors to refer you to another Ausy Hearing contact or request your contact details so another Connect Hearing team member can contact you directly.

f) Prices, rates, and product specifications disclosed by team members during a chat session may vary from time to time.

g) You agree that you will not:

h) Send Online Chat messages that are abusive, discriminatory, defamatory, obscene, pornographic, or otherwise inappropriate or which contain a virus, Trojan horse, worm, or other harmful or disruptive component designed to interrupt, limit or disrupt the functionality of other computer software or hardware;

i) Use Online Chat to publish, distribute, email, transmit or disseminate messages that are abusive, discriminatory, defamatory, obscene, pornographic, or otherwise inappropriate;

j) Engage in any commercial activity including marketing, advertising, or commercial promotion of goods or services, data mine or use robots or other data collection methods; or

k) Breach any laws or regulations which are applicable to your use of the Online Chat in your jurisdiction.

l) Ausy Hearing may at any time discontinue an Online Chat session if you breach these Terms or if you misuse the service in any way.

m) Ausy Hearing reserves the right to, for any reason or no reason (including if Ausy Hearing suspects that the Online Chat is being used in the manner set out in clause 7 or otherwise in violation of breach of the Ausy Hearing Online Chat Terms and Conditions of Use) to read, delete or edit such messages (without providing notice or any reason) and/or to remove you from and prevent your further use of the Online Chat service. Connect Hearing also reserves the right to take any further action it deems necessary or appropriate.

n) Subject to the consumer guarantees provided for in consumer protection legislation (including Indian Consumer Law), Ausy Hearing excludes all liability for any loss, damage, claim, cost, or expense whatsoever arising out of or in connection with these Terms or your use of the Online Chat service.

o) These Terms represent the complete agreement concerning the Online Chat and Ausy Hearing may amend or update these Terms from time to time without notice to you.

p) These Terms will be governed by and construed in accordance with the laws of India. You submit to the exclusive jurisdiction of the courts Chennai and those courts competent to hear appeals from these courts.

q) If any of the provisions of these Terms are deemed unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.

r) Online Chat is subject to change at any time without prior notice and may contain errors.
